Three things, Darbji:

1. Thankfully you are only hurt, not dead!

2. At least you weren't in the Z!

3. Call your lawyer if you haven't done so already!

Again, the most important thing is that you are alive, albeit in pain. Pain goes away, being dead doesn't (unless you are a vampire or zombie-pretty sure you aren't either of those).

I'm so sorry Darb. Like the others said at least you are still here. At least you didn't smash your face and loose teeth or worse.

I know what it's like. Me and a friend were at a dead stop and some lady driving 60mph nailed us in the rear. The way Florida laws work now there was really no point in pursuing things legally. Back in the 1980's I would have been set for life.

Don't know what the laws are like in your state but a lawyer is a good idea. I've had two such accidents and have neck problems and headaches.. Probably will for the rest of my life. I'm not the sueing type and never have been. It has affected me from and from time to time pisses my wife off because she has to rub my neck to alleviate the headaches/relax the muscles.

Don't sign a release form. Hope she was insured.

Glad it wasn't the Z.

I am glad that you are well enough to go home. We will keep you in our prayers.

Our Neon came into our possession because it was "totaled" in a minor fender bender and was thus cheap. But the damage on ours is nearly undetectable. From the looks of that car you were hit HARD.

Au contraire, Hopefully the other driver has insurance (and enough to cover everything)!

Actually in Indiana she will have to provide proof on insurance even if the accident was in no way her fault. If she can't, they will revoke her driver's license. Several members of my family have lived through that experience.

Contact YOUR insurance company as well. You may be eligible to receive from BOTH your and the other driver's policy. Note to others, this is NOT a scam or illegal. (OK, check your state and policy, some have exclusions / limits.) Depending on your policy, someone has to pay the bills NOW, and not be told that the "check is forthcoming". (Does that sound kind of familiar?)

If the other driver did not have sufficient or adequate coverage to cover Darbji's bills, her policy would have to kick in. If they act like "oh no, ...", check with your lawyer. You may very well find out that ...YES they do. You may be eligible for Wage Compensation if you are unable to work.

Same thing applies with the car. The other driver's policy will pay to repair to pre-accident condition or buy (total) your vehicle for the value it had. Start checking with NADA, and Kelly Blue Book and other used car prices. The more info you have, the less possibility of being told .... it's only worth a pittance and therefore we won't repair or pay more than X.

As far as YOUR insurance is considered, you've been in an accident. That you were not at fault is NOT what they will note...just that you were in an accident. That's the reason I recommend checking to see if you're entitled to payment by YOUR policy.

Jimmy has it right as far as NOT signing any "settlement" or "admission" of ANYTHING....until your lawyer has looked it over, and if you don't want a lawyer to get involved, at least some old fart like Will or the rest of us.

The other insurance company WANTS you to settle quickly! That eliminates the possibility of your developing pains and problems that they would be liable for later....if you sign your rights away and need physical therapy in 3 months, because the pain hasn't gone away yet.....follow my drift? That's where it's important to have the "settlement" looked over.

Cassio may have passed on to being a parts donor, but if he prevented you from being hurt permanently, then he went honorably.

Glad to see you signed on after an unfortunate accident. That's a good sign, but watch yourself carefully for the next few days. I've had problems that weren't apparent at first after an accident. Just take care of you...cars are just things.

Darbji, so happy you are ok. Glad it wasn't the Z, but even if it had been, things can be replaced...you can't...

Heed Ronnie's advice. Take it easy for a couple of days because the aches and pains will emerge over the next few days. Sit back, relax and have that boyfriend treat you like the queen you are...
