Excellent post, GWN7!!

Let's put a small portion of this here, in the clear, as it appears in the US Criminal Code~

QUOTE:

18 USCS § 2321

TITLE 18. CRIMES AND CRIMINAL PROCEDURE

PART I. CRIMES

CHAPTER 113. STOLEN PROPERTY

18 USCS § 2321 (2003)

§ 2321. Trafficking in certain motor vehicles or motor vehicle parts

(a) Whoever buys, receives, possesses, or obtains control of, with intent to sell or otherwise dispose of, a motor vehicle or motor vehicle part, knowing that an identification number for such motor vehicle or part has been removed, obliterated, tampered with, or altered, shall be fined under this title or imprisoned not more than ten years, or both.

107 A.L.R.5th 567

SUMMARY: Illegally removing or altering a vehicle identification number (VIN) or selling or possessing a motor vehicle or motor vehicle part with an altered or removed VIN constitutes a crime in most states. In order to impose liability, state courts normally require a culpable mental state on the part of the defendant in altering or removing a VIN or in possessing a vehicle or vehicle part with an altered or removed VIN. Some states, however, do not require any culpable mental state on the part of the defendant when selling a vehicle or vehicle part with a removed or altered VIN.

END QUOTE

Nothing imprecise, ambiguous or unclear after that.

So, 2008 + 10 years = 2018. Imagine being incarcerated in a Federal Penitentiary for a decade, as we all know that there is NO parole in the US Federal Justice System. Ouch.

Bring your lead pipes and rubber hoses boys! ;)

Or simply use the script from the latest "Casino Royale" and bring along a knotted rope.

Poindexter,

How many months or years will you get for incitement, and threatening physical violence with menaces?

OK then, how about this version:

Meh. Now I'm really rooting for the trench coats to come-a-knocking.

Now, is that or is that not a wish - an incitement, a threat however veiled - to violence or physical harm against Sean?

Personally speaking I don't think what Sean was doing was wise ( to put it mildly ), and I think the threat of 'transferred' identities on these cars is something we should all be watching out for and trying to prevent, or flag up when discovered. But threats of physical harm are way out of order and I believe they go against both the spirit and the rules of this forum. You should retract them, and apologise.

All these posts detailing US laws are moot. Sean and the 'kit' in question are located in France, and the 'kit' is no longer on eBay. We now know a chassis number that will be flagged up if it reappears should anybody be naive enough or stupid enough to try and reuse it. Job done I think.

It's the chassis numbers and car identities that have not been offered so brazenly and openly that we need to be looking out for. There's a few of them in our midst. Unfortunately, if you want to point the finger at such 'zombie' cars you had better have a damned good lawyer and the funds to pay him. It can get ugly. I speak from personal experience.

You really have too much time on your hands. Unwise you say? Some understatement. A crime was in fact committed on a US website based in California, as should be adjudicated by their laws and the criminal statutes of the US, whether or not it was withdrawn is MOOT.

Yet all you can see is an obvious joke based upon long-standing cinematic stereotypes. I'll wait while you look that up. Apologist. Go pound the desk with a phony shoe, like Kruschchev. Leave me alone. I don't think I like you, and shan't waste another second with you. Buh bye.

Alan, there are a few points I would like us to consider and then I would agree, “job done”. You stated, “posts detailing US laws are moot”. Maybe in the aspect of Sean’s well being but it is the US citizen that could be enticed to break US federal law and pay the severe penalties imposed upon conviction. If only one person reading this can be swayed from making a “ten year mistake”, I think these posts served us well.

Without any sarcasm or ill wishes I would point out to Sean, that just because action hasn’t been taken against this activity in France, does not mean there are not laws in place to deal with it. All it would take is a change in the political climate of any particular jurisdiction for the hammer to come down. His ignorance of the laws will not matter and he has already amassed damning evidence for all to see. I certainly don’t want anything to come out of this other than the education and protection of our membership and that includes Sean.

Sorry, I don't see an "obvious joke" let alone any "long-standing cinematic stereotypes". I won't be looking it up though.

I missed nothing. I can't vouch for what happened within anybody else's cranium

Seems you think you can now.

Threats of violence to fellow members - regardless of circumstances - should be taken seriously by moderators. I don't remember seeing such things on this forum in the past, and would hope that your threats would be retracted and apologised for. Is a moderator going to have to make you do this? Let's see.

Go edit some more.

Take a moment to look back thorugh this thread and see how many of your posts are edited after you hit the SUBMIT REPLY button. Perhaps you should proof-read a little more before hitting it, not to mention thinking about what you have written. At this moment you're looking like an accident waiting to happen.

This has gotten interesting.

Threats of violence, even torture. Wasn't Bond being tortured? It's not funny. If someone posted a picture of a burning cross would that be funny as long as it was a "long-standing cinematic stereotype".

The white flag thing. It's great fun to call the French Surrender Monkeys, but I seem to recall them helping us out way back 230 years ago or so.

You've got to wonder what kind of world we might be living in had they not.

One of us got it wrong, because that's not what I perceived his post to be saying at all.....

As for the topic at hand, I said, and still believe, that this kit could be used for fraudulent purposes. And I don't think it is wise to sell such a kit to a complete stranger, or to present the kit as it was on eBay.

I do credit Sean for coming in and clarifying his intentions, however.

So, all of this about a "potential" fraudulent act. Armies of straw men built and torn down in the same sentence - the horror!

I'm willing to take on the unenviable task of ridding the earth of this evil. Sean, if you still have the Satanic icons, I'll purchase them. Please send them in a lead lined box with a cross glued to the top. When I receive them I will have a priest perform an exorcism over the icons. Then I will burn them and bury them in an old abandoned mine somewhere in the desert and make the spot with a "666."

God give me strength.

As a French person, I did not take it bad ;)

BTW, if you did not live in the US, I'm not sure you could understand it (this is kind of an US private joke...)

I think this discussion should be closed. We've been around this issue enough to know what to think :)
